SERVICE CANCELLATION AND REFUND POLICY

At Binarquee (“Company”, “we”, “us”, “our”), operating via www.binarquee.com (the “Website”), we deliver highly customized, elite digital marketing, web development, branding, and strategic consulting services. Because our deliverables are intangible, data-first digital products and service hours tailored specifically to individual business blueprints, our returns, cancellations, and refunds are governed by the following strict provisions.

By onboarding as a partner or procuring services from Binarquee, you (“Client”, “you”) acknowledge and accept the terms of this Policy.

1. NO-REFUND POLICY FOR COMPLETED DIGITAL WORK

1.1 Completed Deliverables:

All creative design assets, custom video production raw files, deployed web source codes, completed SEO audits, or executed ad campaign strategies delivered to the Client are non-refundable. Once a deliverable has been built, coded, or published according to the agreed-upon project milestone, it cannot be “returned” or refunded.

1.2 Billable Hours:

Fees paid for strategic consultations, research sprints, or marketing management hours are non-refundable, as they represent direct allocations of expert labor, technical architecture setups, and analytical execution.

2. CANCELLATION OF MONTHLY MARKETING RETAINERS

For ongoing, recurring services (such as Monthly SEO Management, Social Media Management, Meta/Google Ads Retainers):

  • Notice Period: Either party may terminate an ongoing monthly retainer agreement by providing a mandatory thirty (30) days written notice via email.
  • Final Month Obligations: During the 30-day transition period, Binarquee will continue to manage, optimize, and report on all digital assets, and the Client remains fully responsible for the final month’s invoice.
  • Mid-Cycle Cancellations: If a Client requests immediate cessation of work mid-billing cycle, no prorated refunds will be issued for the remaining days of that cycle. All campaign data and structural handovers will be processed at the conclusion of the paid term.

3. WEB DESIGN & MULTI-PHASE DEVELOPMENT PROJECT CANCELLATIONS

For fixed-scope, multi-phase projects (such as custom Web Design & Development, Brand Identity creation, or comprehensive Video Production campaigns) governed by milestone payments:

  • Deposit Payments: Initial setup fees, discovery phase payments, or deposit retainers are 100% non-refundable once project discovery or architectural wireframing has commenced.
  • Mid-Project Termination: In the event the Client wishes to terminate a project before full completion, the Client must submit a formal written termination request. Work will stop immediately.
  • Settlement of Work-in-Progress: The Client will be billed proportionally for all milestones or hours logged up to the exact moment of the cancellation notice. Any unbilled, completed wireframes or creative drafts will only be transferred to the Client upon final payment of the prorated invoice.

4. ADVERTISING SPEND AND THIRD-PARTY PLATFORM COSTS

4.1 Direct Platform Costs:

Binarquee manages ad strategies, but all advertising capital (spent on Meta Ads Manager, Google Ads, LinkedIn Campaign Manager, etc.) is paid directly by the Client to the respective platform.

4.2 Ad Spend Liability:

Binarquee has zero access to, control over, or liability for refunds regarding monies paid to third-party advertising platforms. Any disputes regarding accidental ad delivery, ad account suspension, or platform-side glitches must be handled directly between the Client and the platform provider’s support team.

5. EVENT OF DEFICIENCY IN SERVICE

We pride ourselves on an elite, 95% client retention rate and 100% commitment to excellence. If you believe a specific digital deliverable does not match the clear technical specifications outlined in your signed Service Agreement or Statement of Work (SOW):

  • You must notify us in writing within seven (7) calendar days of receiving the deliverable, explicitly listing the variance or technical error.
  • Binarquee will investigate the report immediately under our quality assurance logic. If a structural error or clear omission on our part is verified, we will prioritize resolving, revising, or recoding the asset at no additional cost to the Client.

6. FORCE MAJEURE

Neither party shall be liable for any delay, failure to perform, or cancellation of digital distribution models resulting from acts beyond their reasonable control, including but not limited to: acts of God, nationwide internet/grid outages, global platform API shutdowns (e.g., abrupt Meta or Google server failures), or government regulations.
